Terms of Use for Animorph

Introduction

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and onEins LLC, a limited liability company duly registered under the laws of the State of Florida, with its principal place of business at 3833 Powerline Rd, Suite 101-K, Fort Lauderdale, Florida 33309, United States. These Terms govern your access to and use of the Animorph mobile application ("Animorph" or the "App"), including all features, functionalities, and services provided therein. By downloading, installing, accessing, or otherwise using Animorph, you expressly agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you are prohibited from using the App, and you must immediately cease any access or use.

1. Definitions

To ensure clarity and precision in interpreting these Terms, the following definitions apply:

"User": Any individual who downloads, installs, accesses, or uses Animorph, whether authenticated or not.
"Animorph": The AI-generated image produced by the App based on a photo uploaded by the User.
"Coins": A virtual currency available for purchase within the App via Apple In-App Purchases ("IAP"), used exclusively to generate Animorphs.
"Styles": Predefined stylistic options (e.g., realistic, artistic) available within Animorph for generating Animorphs, each requiring a specified number of Coins.
"Server": The Google Cloud infrastructure utilized by onEins LLC to store generated Animorphs for User access.
"Database": The Supabase database employed to manage User data, account information, and generated Animorphs.
"Backend": The BuildShip platform that supports Animorph’s backend operations, facilitating seamless functionality.
"Email Service": The Resend service utilized to dispatch emails, including one-time passwords ("OTP") for User authentication.

These definitions establish the foundational terminology for these Terms and are binding in all subsequent sections.

2. User Rights and Responsibilities

onEins LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use Animorph solely for personal, non-commercial purposes, subject to strict compliance with these Terms. As a User, you are permitted to upload photos to generate Animorphs and may purchase Coins through Apple IAP to unlock additional Styles. You bear sole responsibility for ensuring that your use of the App complies with all applicable local, state, national, and international laws and regulations. Prohibited activities include, but are not limited to:

Using Animorph for any illegal, fraudulent, or unauthorized purpose;
Uploading content that is obscene, defamatory, harassing, or infringes upon the intellectual property, privacy, or other rights of third parties;
Attempting to reverse-engineer, decompile, hack, or otherwise interfere with the App’s code, systems, or security measures.
Failure to adhere to these obligations may result in immediate suspension or termination of your access to Animorph, without prejudice to onEins LLC’s other legal remedies.

3. Intellectual Property

By uploading a photo to Animorph, you grant onEins LLC a non-exclusive, worldwide, royalty-free, sublicensable license to store, process, and transform said photo solely for the purpose of generating an Animorph and providing related services within the App. You retain full ownership of both the uploaded photo and the resulting Animorph. onEins LLC claims no ownership interest in your uploaded content or generated Animorphs; however, we reserve the right to store, display, and manage such Animorphs on our Server to facilitate your access and use within the App. Additionally, onEins LLC may utilize anonymized, aggregated data derived from User interactions to enhance and refine the App’s AI algorithms, provided such use does not identify you or infringe upon your rights.

4. Privacy

Animorph collects and processes certain personal and non-personal data to deliver its services, including:

Photos uploaded by you for Animorph generation;
Authentication data (e.g., Apple ID or email address);
Usage data (e.g., App interactions, preferences).
To protect your privacy, uploaded photos are deleted from the Server immediately upon successful generation of an Animorph, with only the resulting Animorph retained for your access. Generated Animorphs are stored securely on the Server and are not disclosed to third parties except as required by law or with your explicit consent. Animorph relies on third-party services—namely Supabase (database), Google Cloud (server), BuildShip (backend), and Resend (email)—each of which may process User data pursuant to their respective privacy policies. 5. Authentication

Animorph offers two authentication methods: (i) Sign in with Apple, whereby minimal data (e.g., Apple ID) is collected solely for verification purposes, and (ii) email-based OTP authentication, requiring you to provide a valid email address to receive a temporary OTP via the Resend service. onEins LLC does not store passwords; OTPs are single-use, time-limited, and designed to ensure secure access. You are responsible for maintaining the confidentiality of your authentication credentials and for all activities conducted under your account.

6. In-App Purchases

Animorph enables the purchase of Coins, a virtual currency, exclusively through Apple IAP. Coins are required to generate Animorphs, with each Style priced at 5 Coins. All transactions are processed via Apple’s payment system, and by purchasing Coins, you agree to abide by Apple’s applicable terms and conditions. Coins are consumable, non-transferable, and non-refundable once expended. Unused Coins may become inaccessible if you delete the App or lose account access, and onEins LLC bears no obligation to restore such Coins. Refund requests must be directed to Apple, as onEins LLC does not control or process refunds for IAP transactions.

7. Generations

Generating an Animorph, whether in a realistic or artistic Style, requires 5 Coins per Style. Upon generation, Animorphs are stored on the Server and made available for you to view or download within the App. You may request the deletion of specific Animorphs by contacting onEins LLC at info@oneins.studio; absent such a request, Animorphs are retained indefinitely to ensure continued access. onEins LLC reserves the right to manage Server storage and may implement retention policies as necessary, with prior notice to Users where feasible.

8. User Conduct

You agree to use Animorph responsibly and lawfully. Specifically, you must not:

Upload photos that are illegal, offensive, or infringe upon the rights of others;
Generate Animorphs for malicious, defamatory, or unlawful purposes;
Engage in any activity that disrupts, damages, or impairs the App’s functionality or security.
onEins LLC retains the unilateral right to remove objectionable content, suspend, or terminate accounts that violate these Terms, at our sole discretion and without prior notice, while reserving all legal rights and remedies.

9. AI Limitations

Animorph employs advanced AI algorithms to produce Animorphs, but onEins LLC does not guarantee the accuracy, quality, or suitability of the generated content. AI results are inherently variable and provided "as is"; you acknowledge that outcomes may not always meet your expectations. onEins LLC disclaims any warranties, express or implied, regarding the performance or fitness of Animorphs for any particular purpose.

10. Data Retention

Generated Animorphs are stored on the Server indefinitely unless you request their deletion by emailing info@oneins.studio. Upon account termination or at onEins LLC’s discretion (e.g., for inactive accounts), stored Animorphs may be deleted following a reasonable retention period, consistent with operational needs and legal obligations.

11. Account Deletion

You may delete your Animorph account at any time through the "Settings" menu within the app. Once you initiate the account deletion process, all associated user data—including your uploaded photos, generated Animorphs, Coin balance, and account information—will be permanently deleted from our systems. Please note the following:

Permanent Deletion: This action is irreversible. Once your account is deleted, neither you nor onEins LLC can recover your data, including any Animorphs or remaining Coin balance.
Loss of Paid Content: Any Coin balance, which you have previously purchased via Apple In-App Purchases, will be forfeited upon deletion. As Coins are non-refundable through onEins LLC, any refund requests must be directed to Apple in accordance with their policies.
User Responsibility: It is your responsibility to download or preserve any Animorphs or other data you wish to keep before deleting your account. onEins LLC shall not be liable for any loss of data or paid content resulting from your decision to delete your account. 12. User Responsibility for Uploaded Images

You are solely responsible for the legality and propriety of photos you upload to Animorph. This includes securing all necessary consents, licenses, or permissions from individuals depicted in such photos. onEins LLC assumes no liability for copyright infringement, privacy violations, or other claims arising from your uploaded content, and you agree to indemnify us against any such claims.

13. Liability

Animorph is offered "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. onEins LLC shall not be liable for:

Errors, defects, or inaccuracies in the App or generated Animorphs;
Service interruptions or unavailability;
Data loss, breaches, or unauthorized access, except where resulting from our gross negligence or willful misconduct.
To the fullest extent permitted by law, our aggregate liability for any claims arising under these Terms or your use of Animorph shall not exceed the total amount you paid for Coins in the 12 months preceding the claim.

14. Termination

You may terminate your use of Animorph by deleting the App or contacting onEins LLC at info@oneins.studio to request account closure. We reserve the right to suspend or terminate your account, with or without notice, for violations of these Terms, suspected misuse, or any other reason at our sole discretion. Upon termination, your access to stored Animorphs and unused Coins may be forfeited.

15. Apple-Specific Terms

Animorph is distributed via the Apple App Store, and your use is subject to Apple’s App Store terms, which you agree to comply with. Apple is not responsible for the App’s content, maintenance, or support. Direct all inquiries or complaints to onEins LLC at the contact details provided herein.

16. Updates to Terms

onEins LLC may modify these Terms at any time to reflect changes in the App, legal requirements, or business practices. Material changes will be communicated via in-App notifications or email. Your continued use of Animorph following such updates constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any disputes arising hereunder shall be resolved exclusively through binding arbitration in Fort Lauderdale, Florida, pursuant to the rules of the American Arbitration Association, with each party bearing its own costs unless otherwise determined by the arbitrator.

18. Age Restrictions

Animorph is intended for Users aged 13 and older. By accessing the App, you affirm that you meet this age requirement. If onEins LLC determines that a User is under 13, we will terminate their account and delete their data in accordance with applicable laws, including the Children’s Online Privacy Protection Act (COPPA).

20. Use of Generated Images

You may use generated Animorphs for personal, non-commercial purposes only. Any commercial exploitation requires prior written consent from onEins LLC. You are responsible for ensuring that your use of Animorphs complies with all applicable laws, including those related to copyright, privacy, and publicity rights.
